Terms and Conditions for Spire Pictures Ltd, trading as Lightspeed Film Co.

1. Introduction

 Welcome to Lightspeed Film Co. By booking and using our video and production services, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before booking. If you do not agree with any part of these terms, you should not engage our services.

2. Booking & Payment Terms

2.1 Booking Process
 Bookings are only confirmed in writing and productions over £2000ex require a 50% deposit to complete the booking.

2.2 Payment in Full
 Final payment is due on completion of the product. Projects that overrun by more than 30 days from expected timeline will be considered billable. 

3. Cancellations & Rescheduling

3.1 Weather & Drone Usage
 If weather conditions are unsuitable for shooting, or drone operations on the shoot day, we will refund half of the related costs (a “stand down” charge). 

3.2 Rescheduling
 Rescheduling is subject to availability, depending on the notice provided and the reason for rescheduling.

4. Services Provided

4.1 Scope of Services
 We will provide production and videography services as outlined our communications and agreed by us. Any additional requests made on the day of the shoot, or in unrecorded correspondences will be accommodated at our discretion and may incur additional fees.

4.2 Participant Performance & Location Appearance
 Lightspeed Film Co. is not responsible for the performance of participants or the appearance of locations during the shoot. It is the client's responsibility to ensure that all participants and locations meet their expectations.

4.3 Pre-Production Information
 The client must submit all required pre-production information to us at least one week prior to the shooting date. Delays in submitting this information may result in delivery timelines, additional editing charges and may impact the final product.

5. Editing & Delivery

5.1 Editing Process
 We will usually deliver the first edit within four working weeks following the shoot date, unless otherwise agree in writing. Any requested amendments will be made within two additional working weeks after we receive the client’s comments.

5.2 Revision Policy
 One round of amendments is included with each project. A second round may be provided at our discretion. Additional rounds of revisions, if requested, may incur additional charges.

5.3 Final Approval
 Once the client approves the final edit, any further changes will incur additional fees. Approval is assumed if no feedback is provided within 7 days of delivery.

5.4 Backup of Data
 Paper Street Video will keep raw footage backed up securely for a period of 1 year from shoot date. 

5.4 Release of Raw Footage

  Release of raw footage is available for £495 + VAT. All usage and licensing of the materials within the footage is the responsibility of the client. It will be delivered to you by post on an external hard drive. 

6. Copyright & Usage Rights

6.1 Ownership
 All raw footage and edited videos are the intellectual property of Paper Street Video. Clients are granted a limited license to use the final product for commercial purposes, online, for one year, unless otherwise agreed.

6.2 Portfolio Use
 Lightspeed Film Co. reserves the right to use footage for portfolio purposes, including on websites and social media. If the client objects, this must be communicated and agreed upon before the shoot.

7. Liability

7.1 Limitation of Liability
 In the event of illness or unforeseen circumstances affecting our team on the shoot day, we will offer a replacement crew. If a replacement is not available, a full refund will be provided.

7.2 Event-Specific Liabilities
 Lightspeed Film Co. is not responsible for any delays, interruptions, or issues that arise from factors beyond our control, including but not limited to weather, technical difficulties, or participant-related delays.

7.3 Professional Indemnity 

 Lightspeed Film Co. Has £100,000 of professional indemnity insurance and will not accept financial responsibility higher than the value of the job in question, minus our expenses.

8. Client Responsibilities

8.1 Permissions & Access
 The client is responsible for obtaining all necessary permissions to film at the location(s). The same applies for participants featured in any productions, music and assets used within the production. Failure to secure these permissions will not result in a refund if services are restricted or canceled. We can offer a production service to procure these permissions, if needed. 

8.2 Schedule & Timing
 Clients are expected to confirm the shooting schedule and pre-production documents. Delays, additions or schedule changes on the day of the event may impact the footage captured and may incur additional fees.

9. Confidentiality

All information shared between the client and Lightspeed Film Co. will remain confidential and will not be shared with any third parties without the client’s written consent.

10. Governing Law

These Terms and Conditions shall be governed by the laws of England. Any disputes arising from these terms will be handled in the jurisdiction of England.

11. Amendments

Lightspeed Film Co. reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any changes in advance, and continued use of our services will constitute acceptance of the revised terms.
